#ForBossesOnly offers a personalized subscription service that enables our members to access exclusive content ("#ForBossesOnly content") over the Internet on certain Internet-connected devices ("#ForBossesOnly compatible devices").

The #ForBossesOnly service is provided to you by ForBossesOnly LLC, a Wyoming-based company. By accepting these Terms of Use, you agree to the terms governing your use of our service. References to "#ForBossesOnly service", "our service", or "the service" in these Terms of Use mean the personalized service provided by ForBossesOnly LLC for discovering and accessing #ForBossesOnly content, including all features, functionalities, recommendations, reviews, our website, user interfaces, and all content and software associated with our service. The term ‘you’ refers to the member who created the #ForBossesOnly account and whose payment method is charged.

 

YOU AGREE TO THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER DESCRIBED IN SECTION 7 TO RESOLVE ANY DISPUTES WITH #FORBOSSESONLY (EXCEPT FOR MATTERS THAT MAY BE TAKEN TO SMALL CLAIMS COURT).

 

Membership 

 

1.1. Your #ForBossesOnly membership will continue and renew automatically until terminated. To use the #ForBossesOnly service, you must have Internet access and a #ForBossesOnly compatible device and provide us with one or more Payment Methods. "Payment Method" refers to a current, valid, accepted method of payment, subject to updates and may include payment through your account with a third party. To avoid billing of membership fees for the next cycle to your Payment Method, cancel your membership before renewal (see "Cancellation" below).

 

1.2. We may offer various membership plans, including those offered by third parties in conjunction with their own products and services. We are not responsible for the products and services provided by these third parties. Different membership plans may have different conditions and limitations, which will be disclosed during your sign-up or in other communications available to you. Specific details regarding your #ForBossesOnly membership can be found by visiting our website and clicking on the "Account" link.

 

Promotional Offers. We may occasionally offer special promotional offers, plans, or memberships (“Offers”). Eligibility for Offers is determined by #ForBossesOnly at its sole discretion, and we reserve the right to revoke an Offer and hold your account if you are found ineligible. Members of households with an existing or recent #ForBossesOnly membership may not be eligible for certain introductory Offers. Information such as device ID, payment method, or an account email address used with an existing or recent #ForBossesOnly membership may be used to determine Offer eligibility. Offer requirements, limitations, and conditions will be provided during your sign-up for the Offer or in other communications.

 

Billing and Cancellation 

 

3.1. Billing Cycle. Membership fees for the #ForBossesOnly service and any other charges incurred in connection with your use of the service, like taxes and potential transaction fees, will be charged to your Payment Method on the specified payment date on the "Account" page. The length of your billing cycle depends on your subscription type. Membership fees are fully earned upon payment. Payment dates may change, for example, if your Payment Method has not successfully settled or if you change your subscription plan. Visit our website and click on "Billing details" in the "Account" page for your next payment date. We may authorize your Payment Method in anticipation of membership or service-related charges as soon as you register. Billing information for memberships made through a third-party account can be found in your account with the respective third party.

 

3.2. Payment Methods. You must provide one or more Payment Methods for using the #ForBossesOnly service. You authorize us to charge any Payment Method linked to your account if your primary Payment Method is declined or not available for your subscription fee. You are responsible for any uncollected amounts. If a payment is not successfully settled due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until a valid Payment Method is charged. The issuer of some Payment Methods may charge fees, such as foreign transaction fees or other fees related to processing. Check with your Payment Method service provider for details.

 

3.3 Updating your Payment Methods. Update your Payment Methods on the "Account" page. We may also update your Payment Methods using information provided by payment service providers. Following any update, you authorize us to continue charging the applicable Payment Method(s).

 

3.4. Cancellation (continued). “Billing details” on the “Account” page. If you signed up for #ForBossesOnly using your account with a third party as a Payment Method and wish to cancel your #ForBossesOnly membership, you may need to do so through that third party, such as by visiting your account with the third party and turning off auto-renew, or unsubscribing from the #ForBossesOnly service through that party.

 

3.5. Changes to the Price and Subscription Plans. We may change our subscription plans and the price of our service from time to time; however, any price changes or changes to your subscription plans will apply no earlier than 30 days following notice to you. If you do not wish to accept a price change or change to your subscription plan, you can cancel your subscription before the change takes effect.

 

3.6. No Refunds. Payments are nonrefundable and there are no refunds or credits for partially used membership periods. Following any cancellation, you will continue to have access to the service through the end of your current billing period. We may, at our discretion, provide a refund, discount, or other consideration to some or all of our members (“credits”). The provision of credits in one instance does not entitle you to credits in the future, nor does it obligate us to provide credits under any circumstance.

 

#ForBossesOnly Service

 

4.1. You must be at least 18 years of age to become a member of the #ForBossesOnly service. Individuals under 18 may only use the service with the involvement of a parent or legal guardian, under their account and subject to these Terms of Use.

 

4.2. The #ForBossesOnly service and any content accessed through our service are for your personal and non-commercial use only. During your #ForBossesOnly membership, we grant you a limited, non-exclusive, non-transferable right to access the #ForBossesOnly service and its content. No right, title, or interest shall be transferred to you otherwise. You agree not to use the service for public performances.

 

4.3. You may access #ForBossesOnly content primarily within the country where you have established your account and only in locations where we offer your subscription plan and have licensed such content. The content available will vary by location and may change over time.

 

4.4. The #ForBossesOnly service, including the content library, is regularly updated. We continually test aspects of our service, including websites, user interfaces, and promotional features. You can opt-out of test participation at any time by visiting the “Account” page.

 

4.5. Depending on your subscription plan, some #ForBossesOnly content may be available for temporary download and offline viewing on certain supported devices. Limitations apply, including restrictions on the number of downloads per account, the number of devices that can contain downloads, the time period for viewing downloads, and how long the downloads will remain accessible.

 

4.6. You agree to use the #ForBossesOnly service, including all features and functionalities, in accordance with all applicable laws, rules, and regulations. You agree not to archive, download, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use content and information from the #ForBossesOnly service, except as explicitly authorized by us.

 

4.7. The display quality of #ForBossesOnly content may vary across devices and can be affected by factors like your location, bandwidth availability, and internet connection speed. We do not guarantee any specific video quality on your display and are not responsible for any internet access charges. Please consult your internet provider for information on possible data usage charges.

 

4.8. The #ForBossesOnly software is developed for, and solely used in, authorized streaming and accessing content from #ForBossesOnly through compatible devices. This software may vary by device and medium, and functionalities might differ between devices. By using our service, you agree to automatically receive updated versions of the #ForBossesOnly and related third-party software.

 

4.9. Any issues related to the device used for accessing #ForBossesOnly should be directed to the device’s manufacturer or seller. We do not take responsibility or warrant the performance of compatible devices, including their continued compatibility with our service.

 

Passwords and Account Access. The account holder is responsible for any activity occurring through the #ForBossesOnly account. By allowing others to access the account, you agree that they are acting on your behalf and that you are bound by any changes they make to the account, including subscription plan changes. To prevent unauthorized access, maintain control over devices used to access the service and do not reveal the password or Payment Method details associated with the account. If your compatible device is sold, lost, or stolen, please deactivate the device. Failure to log out or deactivate your device may allow subsequent users to access the service through your account. To deactivate a device, follow instructions on the “Account” page of our website.

 

Disclaimers of Warranties and Limitations on Liability

 

6.1. THE #FORBOSSESONLY SERVICE AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH, OR ANY OTHER FEATURES OR FUNCTIONALITIES ASSOCIATED WITH THE #FORBOSSESONLY SERVICE, ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. #FORBOSSESONLY DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE #FORBOSSESONLY SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

 

6.2. TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, IN NO EVENT SHALL #FORBOSSESONLY, ITS SUBSIDIARIES, SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, OR LICENSORS BE LIABLE (JOINTLY OR SEVERALLY) TO YOU FOR PERSONAL INJURY OR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER.

 

6.3. YOU MAY ENCOUNTER THIRD PARTY ADVERTISEMENTS ON THE #FORBOSSESONLY SERVICE. #FORBOSSESONLY DOES NOT ENDORSE OR SPONSOR ANY ADVERTISED PRODUCTS OR SERVICES AND TAKES NO RESPONSIBILITY FOR THE PRODUCTS OR SERVICES PROVIDED BY ADVERTISERS. INTERACTIONS WITH ADVERTISERS ARE AT YOUR OWN RISK AND #FORBOSSESONLY IS NOT LIABLE FOR ANY DAMAGES ARISING FROM SUCH INTERACTIONS.

 

6.4. NOTHING IN THESE TERMS OF USE SHALL AFFECT ANY NON-WAIVABLE STATUTORY RIGHTS THAT APPLY TO YOU.

 

Arbitration Agreement

 

7.1. You and #ForBossesOnly agree that any dispute, claim, or controversy arising out of or relating to the #ForBossesOnly service, these Terms of Use, or this Arbitration Agreement, shall be determined by binding arbitration or in small claims court. Arbitration is more informal than a lawsuit in court and uses a neutral arbitrator instead of a judge or jury. You agree that the U.S. Federal Arbitration Act governs the interpretation and enforcement of this provision, and you are waiving the right to a trial by jury or to participate in a class action. This arbitration provision shall survive the termination of this Agreement and your #ForBossesOnly membership.

 

7.2. For arbitration or small claim court actions, you must first send to #ForBossesOnly a written Notice of your claim (“Notice”). The Notice to #ForBossesOnly must be addressed to: General Counsel, ForBossesOnly LLC, 30 N GOULD ST STE R SHERIDAN, WY 82801 (“Notice Address”). If #ForBossesOnly initiates arbitration, it will send a Notice to the email address used for your membership account. A Notice must (a) describe the nature and basis of the claim or dispute, and (b) set forth the specific relief sought (“Demand”). If you and #ForBossesOnly do not reach an agreement to resolve the claim within 30 days after the Notice is received, you or #ForBossesOnly may commence an arbitration proceeding or file a claim in small claims court.

 

7.3. Arbitration will be governed by the Consumer Arbitration Rules of the American Arbitration Association (“AAA”), as modified by this Agreement, and administered by the AAA. The AAA Rules and Forms are available online at www.adr.org, or by writing to the Notice Address. The arbitrator is bound by the terms of this Agreement. Arbitration hearings will take place in your residence county, unless agreed otherwise.

 

7.4. For claims of US$10,000 or less, you may choose the arbitration method based on the AAA Rules. If your claim exceeds US$10,000, the right to a hearing will be determined by the AAA Rules. The arbitrator will issue a reasoned written decision explaining the findings and conclusions on which the award is based. If the arbitrator awards you an amount greater than #ForBossesOnly’s last written settlement offer before an arbitrator was selected, then #ForBossesOnly will pay you the greater of the award amount or US$5,000. All filing, administration, and arbitrator fees will be governed by the AAA Rules.

 

7.5. YOU AND #FORBOSSESONLY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If this provision is found unenforceable, then the entirety of this arbitration provision shall be null and void.

 

Miscellaneous

 

8.1. Governing Law. These Terms of Use shall be governed by and construed in accordance with the laws of the state of Wyoming, U.S.A., without regard to conflict of laws provisions.

 

8.2. Unsolicited Materials. #ForBossesOnly does not accept unsolicited materials or ideas for content, and is not responsible for any similarity of its content to materials or ideas transmitted to #ForBossesOnly.

 

8.3. Feedback. #ForBossesOnly is free to use any comments, information, ideas, or techniques contained in any communication you send to us worldwide and in perpetuity without compensation, acknowledgement, or payment to you for any purpose, including developing and marketing products.

 

8.4. Customer Support. For more information about our service and its features, or if you need assistance with your account, please visit our Help Center on the #ForBossesOnly website.

 

8.5. Survival. If any provision of these Terms of Use is held invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions remain in effect.

 

8.6. Changes to Terms of Use and Assignment. #ForBossesOnly may change these Terms of Use from time to time. Such revisions shall be effective immediately for new members and, for existing members, 30 days after posting unless otherwise stated. We may assign our agreement with you to any affiliated company or entity that succeeds to all or substantially all of our business related to the applicable #ForBossesOnly service.

 

8.7. Communication Preferences. Information relating to your account will be sent electronically, such as via emails to your registered email address. Electronic communications satisfy any legal requirement that such communications be in writing.
